These draft terms describe the intended Treaxures product. They are not ready for user acceptance and do not replace a creator, organisation, partner, seller, provider, payout, or pilot agreement.

1. Who you are contracting with

Treaxures is operated by ESPR Creative Lab Private Limited, a company incorporated in India with its place of business in Aizawl, Mizoram, India. These draft terms are prepared under Indian law; the governing-law clause, the forum for disputes, and any consumer-law carve-out are among the items counsel must settle before they take effect (see §14). No exclusive forum is asserted in this draft.

The registered-office address and corporate identity number must be added here before publication.

Treaxures is not a party to everything you transact through it. Where an expert, seller, business partner, airline, hotel, or app store fulfils what you bought, your contract for that thing is with them, on their terms. §6 to §11 identify who is responsible for what.

2. Access and eligibility

Treaxures is an open platform: a guide reaches the public catalogue once it has passed the applicable local-context, field, safety, accessibility, source, rights, and contributor review, wherever it comes from. Public catalogue pages may be browsed without an account. An account is required for features that need saved state, private content, completion, reviews, Passport records, creator/partner authority, messaging, sessions, or transactions.

The minimum age, guardian-consent flow, paid-feature eligibility, and organisation/partner authority requirements are a release gate pending counsel and store review. Counsel must set the position separately for purchases and subscriptions, marketplace selling and payouts, collectible minting, direct messaging and multiplayer voice, travel booking, and identity submission. Do not enable production acceptance with placeholder ages.

Users must protect their credentials, provide accurate account information, and notify support@treaxures.com of suspected unauthorised access. Accounts may not be used to evade enforcement, fabricate activity, manipulate reviews, impersonate a contributor or partner, or interfere with the service.

3. Field-guide scope and safety

Treaxures provides contextual field-guide information. Route, access, weather, transport, cultural, and safety details can change. Review dates, sources, limitations, and current bulletins should be checked before and during a journey.

Treaxures is not an emergency service and does not guarantee that a route is safe or accessible for every person or condition. The SOS, location-sharing, and alert features depend on your device, your connectivity, and third parties outside our control; they must not be relied on as a substitute for contacting emergency services directly. Users remain responsible for following current law, local instructions, closures, property boundaries, sacred-space guidance, traffic rules, and advice from appropriate emergency or medical services.

The final terms must contain counsel-approved warranties, disclaimers, liability limits, insurance position, force-majeure treatment, and dispute terms. The placeholder liability language from earlier drafts has been removed.

4. Content, sources, media, and reviews

A user or workspace submitting text, routes, sources, media, 3D models, translations, reports, reviews, messages, or other content must have authority to do so and must not:

  • infringe another person's intellectual-property, privacy, publicity, cultural, confidentiality, or data-protection rights;
  • invent or materially misrepresent a person, quotation, source, place, community, partner, price, review, route, safety condition, or right;
  • expose sensitive locations or personal data without an approved basis;
  • submit unlawful, abusive, deceptive, malicious, or unsafe material;
  • manipulate completed-experience eligibility, sentiment, moderation, or commercial disclosure.

Publishing requires the applicable source, local-context, rights, route/field, safety/access, commercial, and copy review. Review applies to an exact revision and scope; it is not a blanket endorsement of its author.

A public review may be submitted only after the corresponding eligible completed journey or booking. Treaxures may moderate, withhold, correct, or remove content and may offer an appeal or correction workflow.

The content licence, contributor-credit obligations, moral-rights treatment, media uses, AI-assistance rules, takedown process, and survival after account deletion must be set out in the counsel-approved creator/organisation agreement and final terms. No broad placeholder licence should be relied on.

5. Creator, organisation, and partner workspaces

Creator Studio is invitation-only and role-scoped. A creator may propose a partner and editorial relationship but cannot claim partner authority, accept terms, set payout details, or activate commerce for that partner.

Contributors keep scoped credit independent of account ownership. Organisations, partners, sellers, providers, reviewers, and staff must act within their granted authority. Material changes can invalidate review or require a new immutable revision.

Compensation, expenses, commission, ownership, licence, disclosure, correction, cancellation, tax, payout, and takedown terms are contract-specific. Treaxures does not promise a universal creator tier, fixed revenue percentage, fixed fund allocation, default price, or payout schedule in these terms.

6. Commercial features: what applies to all of them

A paid guide, real-world service, offer, booking, product handoff, digital good, or other commercial capability may be used only when it is operationally enabled and its required legal, tax, store, and payment review is complete.

Before confirmation, the experience must identify the seller or provider, fulfilment owner, price, taxes and fees, any contractually applicable allocation, commercial relationship, current availability, cancellation/refund terms, and support or grievance contact.

An outbound affiliate handoff must offer the reviewed disclosure and a clean seller link. Enabling attribution does not prove a sale or contribution. Commission is recognised only from reconciled provider evidence. Payment never buys editorial rank, and a paid, affiliate, hosted, or sponsored relationship is disclosed at the recommendation and at the point of action.

Orders, bookings, redemptions, refunds, disputes, settlements, and payouts are server-authoritative and auditable. The exact receipt and accepted terms govern the transaction. Refund timelines, statutory rights, taxes, KYC, invoices, payout eligibility, and seller obligations must be approved for each operating model; the old generic refund and fixed-price promises have been removed.

6.1 Two payment rails, and why it matters to you

Which rail carries a payment is not a preference. The app stores require in-app digital content to be sold through their own billing:

  • Real-world guides, expert consultations and bookings, partner offers, and travel are billed by Treaxures through its payment provider. Treaxures or the named seller is the merchant, Indian consumer law and the published cancellation terms apply, and refunds are requested from Treaxures or that seller.
  • In-app digital goods — marketplace assets, in-quest items, and Treaxures Pro — are billed by Apple or Google. The store is the merchant of record, the store's refund policy applies, and a refund is requested from the store, not from Treaxures. Treaxures grants and revokes the entitlement on the store's instruction; it cannot reverse the store's charge.

Treaxures will not route a digital good through its own payment provider even if asked. The rail decision is enforced in the product and cannot be overridden by a setting.

6.2 Subscriptions and Treaxures Pro

Treaxures Pro is sold through the app store as described in §6.1. Its price, term, renewal behaviour, and cancellation route are the ones the store shows at purchase; you manage and cancel it in your store account.

Pro buys capabilities, not standing. It does not raise, rank, badge, highlight, or otherwise privilege you on any public surface, does not affect how your stewardship record reads to anyone else, and does not buy verification, review, editorial placement, or a decision in your favour. If a benefit would do any of those things, it is not sold.

6.3 Marketplace

A seller lists a digital asset with its licence terms, price, and rights record, and warrants it has the right to license it. A buyer receives the licence stated on the listing and nothing wider. Treaxures operates the marketplace and applies the review, disclosure, and takedown rules in §4; it is not the author of a third-party listing.

Delisting, takedown, refund, and dispute handling for a listing follow the counsel-approved seller agreement, alongside the store's own refund policy for the buyer's charge (§6.1).

6.4 Expert consultations, bookings, and business partners

An expert or business partner is an independent provider, not an employee or agent of Treaxures. They set their availability, scope, and price; they perform the service; and they are responsible for it, including any licence, registration, insurance, or safety obligation their activity requires.

A verification badge names exactly what was checked and when. It is not an endorsement, a guarantee of competence or conduct, and not a warranty of the service. Cancellation, rescheduling, no-show, and refund terms are the ones shown before confirmation.

6.5 Flight and hotel booking

Treaxures searches and books travel through a third-party travel provider. The carrier's or hotel's own contract of carriage, fare rules, and cancellation policy govern the reservation, and they can be stricter than anything on this page — a non-refundable fare is non-refundable. Traveller details must be accurate and must match the identity document that will be presented; a name correction may be impossible or chargeable.

Prices and availability come from the provider and can change or be rejected before the reservation is ticketed. Schedule changes, cancellations, denied boarding, and involuntary refunds are handled under the carrier's or hotel's policy. Treaxures will assist but cannot override it.

6.6 Environmental estimates and carbon offsets

A walking-emissions or travel-emissions figure is a qualified estimate against a published baseline, not a measured reduction, an offset, a credit, or proof of neutral travel. The method, factor, version, and boundary are published, and a figure may not be shown at all until its methodology has been reviewed.

Where an offset is purchasable, the terms must identify the project, the registry, the vintage, the retirement evidence, and the party making the retirement, before purchase. Treaxures does not claim that a purchase makes a journey carbon-neutral.

7. Digital collectibles and the public blockchain

A digital collectible minted through Treaxures is written to a public blockchain. Three things follow, and you accept them by minting:

  • the record is permanent, public, and worldwide, and neither you nor Treaxures can edit or delete it — including in response to a deletion request;
  • the collectible's metadata and image are published to a public content-addressed network (IPFS) and copies may persist independently of ours;
  • you are responsible for your wallet and its keys. Treaxures does not custody them and cannot recover, reverse, or reissue a transaction.

A collectible is a commemorative record of something you did. It is not an investment, a security, a currency, or a promise of resale value, utility, liquidity, or future benefit, and Treaxures makes no representation about what it may be worth. Availability may be limited by law in your jurisdiction and by the app stores' policies.

8. Messaging, sessions, and conduct

Direct messages, consultation threads, and multiplayer sessions — including voice — are shared spaces. They are not end-to-end encrypted, and Treaxures may access their content where a report, a safety concern, or a legal process requires it.

Harassment, threats, sexual content involving minors, hate speech, doxxing, spam, fraud, and attempts to move a transaction off-platform to evade these terms are prohibited. Block, mute, and report controls are available in every such surface, and a report is reviewed against the same rules regardless of who made it. Recording another participant without the disclosure the product shows is prohibited.

9. Impact Passport and public sharing

The Impact Passport is private by default. Records identify whether their source is a completion, transaction, confirmation, observation, or estimate. They do not create public authority or an entitlement to preferential treatment, and they are not ranked, scored, or combined into a single figure.

Users may share only the fields offered in the visibility controls. Treaxures may update or reverse a record when its source transaction, confirmation, or release changes while preserving the audit history required by the approved retention policy.

10. Private previews and pre-release access

Private preview access is invitation-only, revocable, and does not authorise public sharing of what you see. Preview material is labelled and must not be presented as a released guide.

Features compiled into an app are not promised to be operational. A capability may be withdrawn, gated, or changed before or after release.

11. Enforcement, suspension, and service changes

Treaxures may restrict a capability, pause a release or transaction, remove content, or suspend an account when needed for safety, rights, fraud, abuse, legal process, partner offboarding, or policy enforcement. A reason, appeal route, and notice should be provided where appropriate and lawful.

Where an account is suspended or closed, the counsel-approved terms must state what happens to an unspent entitlement, an open booking, a listed asset, and a pending payout.

12. Administrative access

Treaxures staff can reach production data through an internal, capability-scoped admin console protected by multi-factor authentication. Every privileged action is recorded in an audit trail. Staff access is used to operate, support, secure, and moderate the service, and for no other purpose.

13. Privacy, deletion, and support

You can close your account yourself from Profile → Settings → Delete Account and export your data from Download My Data in the same place. Deletion runs on a 30-day grace period that you can cancel; the Data Deletion page sets out exactly what is deleted, detached, or retained, and the draft Privacy Policy covers the rest. Neither is effective until approved alongside these terms.

Deletion cannot reach a public blockchain entry (§7), a reservation held by a carrier or hotel (§6.5), or a purchase record held by an app store (§6.1).

Before these terms become effective, counsel must approve at least: entity and address disclosures; acceptance and versioning; age/guardian controls per capability; consumer and e-commerce obligations; seller/provider responsibilities; marketplace and licence terms; store-billing and subscription disclosures against Apple and Google policy; travel intermediary status and disclosure obligations; digital-collectible and virtual-asset treatment, including its tax and regulatory position in each market of sale; messaging and voice moderation and lawful-interception obligations; IP and cultural rights; moderation and appeals; payment/refund/payout language; tax and KYC; warranties and liability; governing law and disputes; notices and response periods; termination; survival; and change notification.

The production release must bind acceptance to the exact immutable approved version.
